Terms of Service
Welcome to Callio.
These Terms of Service ("Terms") govern your access to and use of Callio, including our website, random voice calling service, text chat features, and any other services, features, or applications that link to these Terms (collectively, the "Service").
Please read these Terms carefully. By accessing or using Callio, you agree to these Terms and our Community Guidelines. Our Privacy Policy explains how we collect, use, and handle information in connection with the Service.
If you do not agree to these Terms, you must not access or use Callio.
1. Who We Are
Callio is an online communication service designed to help people meet and speak with new people through one-to-one voice conversations.
The Service may allow you to be randomly matched with another user, communicate by voice, exchange text messages during a call, manage a guest profile, receive or make certain call requests, and use other communication or safety features made available by Callio.
Callio is provided under the Callio name as an online communication service.
For questions about these Terms, you can contact us at [SUPPORT EMAIL].
2. Who May Use Callio
You must be at least 18 years old to use Callio.
Callio is not intended for children or minors. By accessing or using the Service, you represent that you are at least 18 years old and legally capable of agreeing to these Terms.
You must not use Callio if:
- you are under 18;
- you are prohibited from using the Service under applicable law;
- your access to Callio has previously been suspended or terminated and you are attempting to evade that restriction without our permission; or
- you are using the Service on behalf of another person without authority to do so.
We may take reasonable steps to enforce our age requirements and protect users. Where we reasonably believe that a user is under 18, we may restrict or terminate access to the Service.
Do not falsely claim to be an adult in order to access Callio.
3. Using the Service
Callio allows users to communicate with people they may not know.
When you start a random call, Callio may attempt to match you with another available user. We do not guarantee that a match will always be available, that matching will happen immediately, or that a particular user will remain available.
You are responsible for your interactions with other users.
People you meet through Callio are strangers unless you already know them independently. Callio does not guarantee the identity, age, location, background, intentions, or statements of any user.
A display name, profile picture, country indicator, biography, or other profile information must not be treated as verified identity information unless Callio explicitly states otherwise.
Use appropriate caution when communicating with other users.
You should never send money to someone you meet through Callio or share passwords, authentication codes, financial information, government identification numbers, or other highly sensitive information with strangers.
4. Guest Profiles and Identity
Callio may allow you to use the Service without creating a traditional registered account.
The Service may create or store a guest identity and allow you to choose or edit certain profile information, such as a display name, profile picture, or biography.
You are responsible for the profile information you provide or select.
You must not:
- impersonate another person or organisation;
- falsely claim to represent Callio;
- use a name, profile image, or biography to deceive or defraud another user;
- use profile information that violates another person's rights;
- use profile information to harass, threaten, or target another person; or
- present yourself in a way that violates our Community Guidelines.
Guest access does not prevent Callio from taking moderation or safety action.
Deleting local browser data, changing a guest profile, using a different display name, or otherwise changing visible profile information does not give you permission to evade a suspension, ban, or other enforcement action.
5. Calls and Interactions With Other Users
Callio is designed for live communication between users.
You decide what you say and share during a conversation. You are responsible for your own conduct and communications.
You must comply with our Community Guidelines whenever you use the Service.
Among other things, you must not use Callio to:
- harass, bully, stalk, intimidate, or threaten another person;
- promote hatred or attack people based on protected characteristics;
- engage in sexual harassment or unwanted sexual conduct;
- share pornographic, sexually explicit, or otherwise prohibited sexual content;
- sexually exploit, groom, or endanger minors;
- encourage suicide, self-harm, or dangerous acts;
- make credible threats of violence;
- promote terrorism or violent extremist activity;
- scam, defraud, or deceive users for financial or other gain;
- impersonate another person;
- distribute malware or malicious links;
- spam users or misuse communication features;
- expose another person's private or identifying information without permission;
- engage in illegal activity; or
- help another person violate these Terms or our Community Guidelines.
The Community Guidelines provide more detail about conduct that is not allowed on Callio.
6. Voice Calls and Recording
Callio is primarily a voice communication service.
You must respect the privacy of the people you speak with.
You must not record, capture, reproduce, publish, livestream, distribute, or otherwise share another user's voice or conversation without obtaining any consent required by applicable law.
Recording laws differ between countries and jurisdictions. You are responsible for understanding and following the laws that apply to you.
Callio's permission to use the Service does not give you permission to record another person.
If you choose to share personal information during a conversation, you do so at your own discretion. Consider carefully what you disclose to strangers.
7. Text Chat and Other Communications
Callio may allow users to exchange text messages or other communications during a call.
You are responsible for the content you send.
Do not use text chat or any other communication feature to send prohibited content, malicious links, scams, spam, threats, private information belonging to another person, or content that violates our Community Guidelines.
The availability of text chat does not change the rules that apply to voice conversations.
Callio may change, limit, or discontinue communication features as the Service develops.
8. Community Guidelines
Our Community Guidelines form part of the rules for using Callio.
They explain the types of behaviour and content that are not allowed on the Service.
You agree to follow the Community Guidelines whenever you use Callio.
A violation of the Community Guidelines may also be a violation of these Terms.
Depending on the circumstances, we may take action including issuing a warning, limiting access to features, ending a session, restricting access to the Service, suspending access, or banning a user.
Serious conduct may result in immediate action.
9. Reports and Safety
Callio provides reporting and moderation features intended to support user safety.
If you believe another user has violated these Terms or our Community Guidelines, you may use the available reporting tools.
You must submit reports in good faith.
You must not knowingly submit false, fabricated, misleading, or abusive reports. You must not misuse reporting tools to harass another user or manipulate our moderation systems.
When reviewing a report, Callio may consider information reasonably available to us in connection with the report and the operation or safety of the Service.
Submitting a report does not guarantee a particular moderation outcome.
We may prioritise reports based on factors such as apparent severity, immediate safety concerns, available information, repeated conduct, and the risk of harm.
If you or another person is in immediate danger, contact the appropriate local emergency services. Callio is not an emergency service and does not provide emergency response services.
10. Moderation and Enforcement
We may investigate suspected violations of these Terms, our Community Guidelines, or applicable law.
Where appropriate, we may take proportionate action to protect users, the Service, or others.
Actions may include:
- issuing warnings;
- limiting features;
- ending or restricting sessions;
- restricting matching or communication functionality;
- temporarily suspending access;
- permanently terminating access;
- preserving information where required or permitted by law; or
- cooperating with competent authorities where legally required.
The action we take may depend on the seriousness of the conduct, the context, available information, repeated violations, and potential harm to users or the Service.
We do not promise to review every report within a specific period unless applicable law requires otherwise.
We may use automated systems, technical signals, and human review to support safety, abuse prevention, and enforcement where appropriate.
Where applicable law gives you the right to receive reasons for a moderation decision or challenge that decision, Callio will provide the required process.
11. Suspensions, Bans, and Ban Evasion
If we suspend or terminate your access to Callio, you must comply with that restriction.
You must not attempt to evade enforcement by:
- creating or resetting guest identities;
- clearing browser or application data;
- changing profile information;
- using another person's access;
- manipulating device or network information;
- exploiting technical weaknesses; or
- using any other method intended to bypass a restriction.
Attempts to evade enforcement may result in additional restrictions.
If you believe an enforcement action was made in error, you may use any appeal or contact process made available by Callio.
12. Your Content and Communications
You retain any rights you have in content that you create and share through Callio.
You are responsible for ensuring that you have the necessary rights to share that content.
You grant Callio a limited, non-exclusive, worldwide licence to host, transmit, process, reproduce, and otherwise technically use content you submit to the Service only to the extent reasonably necessary to:
- operate the Service;
- deliver your communications;
- maintain the Service;
- provide safety and moderation functions;
- investigate reports or abuse;
- comply with legal obligations; and
- enforce these Terms and our Community Guidelines.
This licence does not transfer ownership of your content to Callio.
The licence ends when the relevant content is no longer reasonably required for these purposes, subject to legal obligations, legitimate safety needs, technical limitations, and the data retention practices described in our Privacy Policy.
13. Callio's Service and Intellectual Property
Callio and its licensors retain all rights in the Service and its associated intellectual property.
This includes, where protected by law:
- the Callio name and branding;
- logos;
- mascots;
- graphics;
- website and application designs;
- software;
- source code owned by Callio;
- interface elements;
- original illustrations; and
- other original Callio materials.
These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms.
They do not transfer ownership of the Service or Callio's intellectual property to you.
You must not copy, sell, license, distribute, or commercially exploit Callio's protected materials except where we have given permission or applicable law allows you to do so.
Nothing in these Terms restricts rights that cannot legally be restricted.
14. Misuse of the Service
You must not interfere with or misuse Callio.
You must not:
- access the Service using unauthorised automated systems;
- scrape the Service in violation of applicable law or our rights;
- probe or scan systems for vulnerabilities without authorisation;
- bypass access controls or safety systems;
- interfere with matching, calls, WebRTC connections, or communication systems;
- deliberately overload the Service;
- distribute malware;
- reverse engineer the Service except where applicable law expressly permits it;
- attempt to obtain another user's technical or private information without authorisation;
- manipulate reports or moderation systems;
- use Callio to build a competing dataset through unauthorised collection of user information; or
- encourage or assist others in doing these things.
You may conduct security research only with our prior authorisation or under a security disclosure policy that we make available.
15. Third-Party Services and Links
Callio may contain links to, integrate with, or rely on third-party services.
Third-party services are governed by their own terms and privacy practices.
Callio does not control every third-party website or service and is not responsible for third-party content, products, or services merely because they are linked from or technically used by Callio.
You should review the terms and privacy policies of third-party services you choose to use.
Nothing in this section limits responsibility that cannot be excluded under applicable law.
16. Changes to the Service
Callio is an evolving service.
We may add, change, test, limit, or remove features.
We may also perform maintenance or make technical and safety changes.
We do not guarantee that every feature will remain available permanently or that the Service will always operate without interruption.
Where applicable law requires notice of a material change, we will provide appropriate notice.
17. Service Availability
We aim to keep Callio available and functioning, but we cannot guarantee uninterrupted or error-free operation.
The Service may be unavailable because of maintenance, technical problems, internet or hosting failures, security incidents, third-party service failures, legal requirements, or circumstances outside our reasonable control.
Voice communication depends on factors that may be outside Callio's control, including your device, microphone, browser, internet connection, network conditions, and the systems used by another user.
Call quality, connection stability, and matching availability may vary.
We may temporarily limit or suspend parts of the Service where reasonably necessary for maintenance, security, abuse prevention, legal compliance, or protection of the Service and its users.
18. No Guarantee About Other Users
Callio does not control everything that users say or do during live conversations.
We use safety and moderation measures, but we cannot guarantee that every user will follow these Terms or our Community Guidelines.
We do not guarantee that another user is truthful about their identity, age, location, intentions, background, or any other information they provide.
You should use reasonable caution when interacting with strangers.
Callio does not conduct a comprehensive background check on every person using the Service.
Nothing in these Terms means that Callio endorses statements, advice, opinions, offers, or representations made by users.
If another user makes you uncomfortable, you should end the conversation and use the available reporting or blocking features where appropriate.
19. Disclaimers
Callio provides the Service on an "as is" and "as available" basis, subject to rights and protections that cannot be excluded under applicable law.
To the extent permitted by law, we do not guarantee that:
- the Service will always be available;
- the Service will be uninterrupted or error-free;
- every technical issue will be corrected immediately;
- you will always find another user to speak with;
- a particular match will be suitable for you;
- information provided by users will be accurate;
- users will comply with these Terms or our Community Guidelines; or
- the Service will meet every user's individual expectations.
Nothing in these Terms excludes any legal guarantee, consumer right, or other protection that cannot lawfully be excluded or limited.
20. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms limits rights or remedies that you have under mandatory consumer protection law.
To the extent permitted by applicable law, Callio will not be responsible for indirect or consequential losses that were not reasonably foreseeable when you agreed to these Terms.
Callio is not responsible for losses caused solely by:
- your violation of these Terms or our Community Guidelines;
- information you voluntarily disclose to another user;
- unauthorised conduct by another user that Callio could not reasonably prevent;
- your device, internet connection, browser, microphone, or network provider;
- third-party services outside Callio's reasonable control; or
- circumstances outside our reasonable control.
This section does not exclude or limit liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot be excluded, or any other liability that applicable law does not permit us to exclude or limit.
21. Indemnity Where Permitted by Law
To the extent permitted by applicable law, if your intentional or unlawful conduct causes Callio to suffer losses, claims, or reasonable costs, you may be responsible for those losses, claims, or costs.
This may apply where you seriously violate these Terms, infringe another person's rights, misuse the Service, or use Callio for unlawful activity.
This section does not create obligations that cannot lawfully be imposed on you under applicable consumer law.
22. Termination
You may stop using Callio at any time.
Where available, you may also remove or reset certain locally stored profile information through the Service or your browser.
We may restrict, suspend, or terminate your access to the Service where reasonably necessary, including where:
- you violate these Terms;
- you violate our Community Guidelines;
- your conduct creates a safety or security risk;
- you repeatedly misuse the Service;
- you attempt to evade enforcement;
- we are required to act by law or a competent authority; or
- continuing to provide access would expose Callio, its users, or others to material harm.
Where appropriate and required by applicable law, we may provide information about the reason for an enforcement decision and any available method of appeal.
Sections of these Terms that by their nature should continue after termination may remain in effect. This includes provisions relating to intellectual property, responsibility for past conduct, limitations of liability, and dispute-related provisions.
23. Changes to These Terms
We may update these Terms as Callio develops.
We may make changes because of:
- new or changed features;
- safety or moderation developments;
- changes to our business or operations;
- legal or regulatory requirements;
- security concerns; or
- changes intended to make these Terms clearer.
When we make material changes, we will provide notice where required by applicable law.
The updated Terms will show a new "Last updated" date.
Where required, we may ask you to accept updated Terms before continuing to use the Service.
Changes will not apply retroactively where applicable law prohibits retroactive application.
24. Privacy
Our Privacy Policy explains how Callio collects, uses, shares, and retains information in connection with the Service.
By using Callio, you acknowledge that you have been provided with access to our Privacy Policy.
The Privacy Policy does not replace these Terms, and these Terms do not replace the Privacy Policy.
If you have questions about how Callio handles personal information, please use the contact details provided in the Privacy Policy.
25. Applicable Law and Consumer Rights
These Terms are subject to applicable law.
These Terms are governed by applicable law, and any dispute will be handled by the courts, authorities, or consumer-protection bodies that have jurisdiction under that law.
Nothing in these Terms deprives you of mandatory consumer protections or other rights that apply to you under the law of your country of residence where those rights cannot legally be waived.
Nothing in this section limits any court, regulator, or consumer-protection forum that must remain available to you under applicable law.
26. Disputes
If you have a concern about Callio, we encourage you to contact us first so that we can try to understand and resolve the issue.
You may contact us using the details listed in the "Contact Us" section.
Nothing in these Terms prevents you from using a court, regulator, consumer protection body, dispute resolution mechanism, or other remedy where you have a legal right to do so.
Where applicable law requires a specific dispute or complaint process, that process will apply.
27. General Terms
If a court or competent authority finds that part of these Terms is invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Our failure to enforce a provision of these Terms immediately does not automatically mean that we permanently waive our right to enforce it.
You may not transfer your rights or obligations under these Terms to another person without our permission where such permission may lawfully be required.
Callio may transfer its rights or obligations as part of a reorganisation, merger, acquisition, sale of assets, or similar business transaction, subject to applicable law and any required notice.
These Terms, together with the Community Guidelines and any additional terms expressly incorporated into them, form the agreement governing your use of the Service.
Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between you and Callio.
